Who is this visa for?
This visa allows you to enter or remain in Australia on the
basis of your married or de-facto relationship with your
partner:
- on a temporary visa (usually for a waiting period of
approximately two (2) years from the date you applied
for the visa)
- on a permanent visa if, after the waiting period (if
applicable), your partner relationship still exists and
you are still eligible for this visa.
Your partner must provide sponsorship for you.
Your partner must be one of the following:
- an Australian citizen
- an Australian permanent resident
- an eligible New Zealand citizen.
What does the visa let
you do?

PARENT VISA

If you are outside Australia
A permanent visa for parents who have children living in
Australia.
A permanent visa for parents with children living in
Australia. This visa costs more than the Parent visa but is
generally processed faster.
This is a temporary visa valid for two years. If you hold
this visa you can then apply for the permanent Contributory
Parent visa (subclass 143).
This visa is for holders of a temporary Contributory
Parent visa (subclass 173), who want to apply for a
permanent Contributory Parent visa (subclass 143).
If you are in Australia
A permanent visa for aged parents to remain in Australia.
Applicants must have children who are living in Australia.
A permanent visa for aged parents with children living in
Australia. This visa costs more than the aged parent visa
but is generally processed faster.
This is a temporary visa valid for two years. If you hold
this visa you can apply for the permanent Contributory Aged
Parent (Residence) visa (subclass 864).
For holders of a temporary Contributory Aged Parent visa

103)
You must meet the following requirements to be eligible to
apply for this visa.
Child in Australia
You must be the parent of a child who is settled in
Australia as one of the following:
- an Australian citizen
- an Australian permanent resident
- an eligible New Zealand citizen.
Eligible sponsor
You must be sponsored by an eligible sponsor. Usually,
your child will sponsor you. If your child is under 18 years
you may also be sponsored by one the following:
- your child's spouse
- a close family relative or guardian of your child
- a close family relative or guardian of your child's
spouse
- a community organisation.
Assurance of Support
You must have a commitment by a person prepared to
provide you with an Assurance of Support.
Balance of family test
The balance of family test requires that:
- half your children must be permanently resident in
Australia
or
- you have more children permanently resident in
Australia than any other single country.
Health
You, your spouse and all dependent family members must
meet certain health requirements and will need to undergo a
health examination.
Character
You, your accompanying spouse and all dependent family
members aged sixteen and above must meet the character
requirements.
Debts to the Australian
Government
Before you can be granted this visa you must repay, or
have made arrangements to repay, any outstanding debts to
the Australian Government.
Limitations on applications
If you are in Australia, you may be prevented from
applying for this visa if, for example:
- you do not hold a substantive visa (which is any
visa other than a bridging visa, a criminal justice visa
or an enforcement visa) and had a visa cancelled or
refused since you last arrived in Australia
- your last visa was granted on the condition that you
would not be granted a substantive visa while you remain

Contributory Parent (Migrant) Visa
(Subclass 143)
Applicants for non-contributory parent visas may have to wait
many years before being granted a visa, as the
Government limits the number of places available each program year.
To manage demand fairly, people who apply and meet core criteria for
the grant of this visa, are placed in a global queue.
Because of long waiting periods, applicants may choose to apply
for a Contributory parent visa where applicants (or their sponsor)
pay a much larger visa application charge and Assurance of Support
bond. Applicants (or their sponsor) are contributing to Government
revenue and helping to offset some costs placed on the community by
parent migration. The Government also limits the number of places
available for Contributory parents each year, but there are more
places available so the waiting period for grant of a Contributory
parent visa is much shorter.

Contributory Parent (Migrant) Visa
(from Subclass 173 to Subclass 143)
If you are applying for the Contributory Parent (Migrant)
(subclass 143) permanent visa and have held a Contributory
Parent (Temporary) (subclass 173) visa at any time since you
have been in Australia, you may be eligible to apply for the
permanent visa and receive certain visa processing
concessions. However, at time of application, you must be
able to satisfy one of the criteria defining who is
a holder of subclass 173 (Contributory Parent Temporary))
visa. A holder of a subclass 173 (Contributory Parent
(Temporary)) visa is a person to which one of the
following applies:
- currently holds a Contributory Parent (Temporary)
(subclass 173) temporary visa
- has held a Contributory Parent (Temporary) (subclass
173) visa at any time in the 28 days immediately before
making the Contributory Parent (Migrant) (subclass 143)
visa application
- has held a Contributory Parent (Temporary) (subclass
173) visa and provides the department with evidence
(i.e. documentation attached to the application) that
compassionate and compelling circumstances exist for the
person to be considered to be the holder of a
Contributory Parent (Temporary) (subclass 173) for the
purpose of the Contributory Parent (Migrant) (subclass
143) visa application.
Note: If you are unlawful at time of
application your immigration status in Australia will be
affected.
You must also meet the following eligibility requirements
to apply for this visa.

Aged
Parent Visas
These visas are for parents whose age is equivalent to a
person who is eligible for an Australian Age pension.
An aged parent making a parent visa application will not
immediately be entitled to an Age pension after being
granted a permanent visa. All new Australian permanent
residents must wait 10 years before being eligible to
receive the Age pension (unless there is a reciprocal
agreement with another country that pays you a pension) or
Disability pension

Contributory Parent (Migrant) Visa
(from Subclass 884 to Subclass 864)
If you are applying for the Contributory Aged (Residence)
Parent (subclass 864) permanent visa and have held a
Contributory Aged Parent (subclass 884) temporary visa at
any time since you have been in Australia, you may be
eligible to apply for the permanent visa and receive certain
visa processing concessions. However, at time of
application, you must be able to satisfy one of the criteria
defining who is a holder of a subclass 884
(Contributory Aged Parent (Temporary)) visa. A holder of a
subclass 884 (Contributory Aged Parent (Temporary)) visa
is a person to which one of the following applies:
- currently holds a Contributory Aged Parent
(Temporary) (subclass 884) visa
- has held a Contributory Aged Parent (Temporary)
(subclass 884) visa at any time in the 28 days
immediately before making the Contributory Parent
(Residence) (subclass 864) visa application
- has held a Contributory Aged Parent (Temporary)
(subclass 884) visa and provides the department with
evidence (i.e. documentation attached to the
application) that compassionate and compelling
circumstances exist for the person to be a holder of a
Contributory Aged Parent (Temporary) (subclass 884) for
the purpose of the Contributory Aged Parent (Residence)
(subclass 864) visa application.
Note: If you are unlawful at time of
application your immigration status in Australia will be
affected.
You must also meet the following eligibility requirements
to apply for this visa.

Citizen Family Relationship (Temporary) Visa
You are eligible for this visa if
you are a member of the family of a person who is either:
- in Australia as the holder of a Special Category
(subclass 444) visa
- outside Australia, and
- will be accompanying you to Australia
- on entry, will be the holder of a Special
Category visa.
You must be related to the Special Category visa holder
as one of the following:
- their spouse

visa application.
If you lodge your application outside Australia, you must

You may be required to hold private health insurance with
a fund in Australia if you are the citizen of a country that
does not have a reciprocal health care agreement with

How this Visa Works
This visa allows non-New Zealand citizens to travel to
and live in Australia with a New Zealand citizen family
member who is a Special Category visa holder.
Bringing family
All family members must apply for their own visa as a
family member of the Special Category visa holder. You
cannot make a combined application on the one form.
Visa validity period
This is a temporary visa and it is valid for up to five
(5) years.
Renewing your visa
You can renew your visa, even if your relationship with
the Special Category visa holder has ended, provided that:
- you have maintained Australian residency; you must
have been in Australia for a total of at least two (2)
years in the last five (5) years
- you continue to meet standard health and character
requirements
- you do not become the member of a family of another
person (other than another Special Category visa holder)
- if you are currently outside Australia, you held
this visa when you left Australia.

Child
(Permanent)
Sponsorship
The child must be the natural, adopted or step child of
their sponsor, who must be an Australian citizen, the holder
of an Australian permanent visa, or an eligible New Zealand
citizen.
Step-children
A step-child can only be included in the Child visa
category if the step-child is under 18 years of age and the
sponsoring step-parent is no longer the spouse of the
child’s natural or adoptive parent but has a legal
responsibility to care for the child.
Adopted children
Certain circumstances must be met for adoptive parents to
apply for this visa on behalf of the child.
If the child is an adopted child applying inside Australia,
and they were adopted either before or after the sponsoring
parent became an Australian citizen, permanent resident, or
an eligible New Zealand citizen, they should apply for this
visa.
Dependency
The child must be dependent on their sponsor. A child
under 18 years of age is considered to be dependent. However
for a child 18 years of age or older to be considered
dependent, they must rely more on their sponsor than on any
other person or source of financial support in either one of
the circumstances below:
- to meet their basic needs of food, shelter and
clothing, and they must have relied on this support for
a substantial period (usually 12 months)
- because of a disability that prevents them working
to support themselves.
Note: Disability means that the child
has total or partial loss of his or her bodily or mental
functions, and they are unable to work because of it.
Age
The child must be under 25 years of age when the visa
application is lodged. If the child is 18 years of age or
older, they must also be a full-time student and
financially dependent on their sponsoring parent.
To be considered a full-time student, the child must:
- be validly enrolled, and actively participating, in
a full-time post-secondary course of study leading to a
professional, trade or vocational qualification
- have been undertaking that course since turning 18
years of age, or have commenced studies within six (6)
months or a reasonable period of completing secondary
education
- not be in full-time employment.
Note: The only exception to this age
limit and full time student requirement is where the child
has a disability that stops them from working.
Marital status
The child must be single. They must not be married, in a
de-facto relationship or engaged to be married.
Note: If the child is 18 years of age or
over, the child must not only be single, but they must never
have been married or had a de-facto spouse.
Health
The applicant must meet health requirements.
Character
Applicants who are 16 years of age or over must be of
good character to enter or remain in Australia.
Reliance on social
security
If the applicant, or their sponsor, is likely to become a
high user of Australia's social security system, an
Assurance of Support (AoS) from an Australian citizen or
Australian permanent resident may be required. If required,
the department will advise how an Assurance of Support can
be obtained.

Orphan Relative
To be eligible for this permanent visa you must fulfill the

parents are unable to look after the child because they are
deceased, permanently incapacitated or of unknown
whereabouts.
An orphan relative must be the brother, sister,
grandchild, niece, nephew or step equivalent of their

holder of an Australian permanent visa, or an eligible New
Zealand citizen, who undertakes sponsorship obligations.

Applicant must be under 18 years of age when their visa
application is lodged. If the applicant is under 18 when the
visa application is lodged, but will turn 18 before the
application is decided, they may still be eligible for this
visa if they meet the other requirements of the visa.

The child must be single. They must not be married or in
a de-facto relationship.

The applicant must meet health requirements.
Character
Applicants who are 16 years of age or over must be of

Dependent Child
Visa (Subclass 445)
Relationship and custody
The child must be the natural, adopted or step child of a
parent who holds one of the following visas:
- a temporary Spouse visa (subclasses 309 or 820)
- a temporary Interdependency visa (subclasses 310 or
826)
- an Extended Eligibility visa (subclass 445).
The child's parent must also satisfy one of the
following:
- they have the sole legal right to determine where
the child shall live, or to remove the child from their
home country
- if another person can legally determine where the
child can live, they must obtain a statutory declaration
from this person or people, granting permission for the
child to migrate
- they possess a valid court order allowing them to

must provide support for the child, including
ensuring the provision of accommodation and
providing financial assistance required to meet the
child's reasonable living needs:
- during their first two (2) years in
Australia (if the child is applying overseas)
- for the two (2) years following the grant of
the child's visa (if the child is applying in
Australia).

Applicant (Child) |
A complete application must be
lodged for the applicant, including all application
forms, supporting documentation and application
charges. If the application meets all visa criteria,
the applicant may be granted this visa. The
child's parent will usually lodge the application on
behalf of the child.
Note: After being granted this
visa, a separate application must be lodged for the
child for the same permanent visa as their parent.
This application must be lodged before
a decision is made on the parent's permanent visa
application. |
Visa validity period
This visa is valid until a decision is made on the
parent's permanent Spouse or Interdependency visa
application, or until the parent's visa application is
withdrawn.

Adoption
(Permanent) (Subclass 102)
Certain circumstances must be met for adoptive or
prospective adoptive parents to apply for this visa on
behalf of the child.
Adoptive parents living in
Australia
Your relevant Australian State or Territory Adoption
Authority (STAA) must be involved in managing the adoption
process with the overseas country where the child is living.
If you are considering adopting a child from overseas,
you should contact the adoption authority in your state or
territory.
Adoptive parents living
overseas
The following circumstances apply for adoptive or
prospective adoptive parents who are living overseas:
- you must have been living overseas for the 12 months
prior to making an application for this visa
- your residence overseas was not solely to adopt a
child
- the adoption was in accordance with the laws of the
country in which the child lives
- the adoption gives you full and permanent parental
rights (i.e. the adoption severs the legal ties between
the child and its birth parents).
or
You have adopted the child under an arrangement between
two (2) Hague Convention countries other than Australia.
Privately arranged adoptions
Australian State and Territory Adoption Authorities do
not generally support privately arranged adoptions,
including the adoption of children who are relatives. They
will not help applicants/sponsors to meet the visa
requirements for granting a visa to an adopted child.
The concept of adoption does not exist in the laws of
some countries.
Example: Many Islamic countries
An adoption order which does not grant full parental
rights to the adoptive parents is not acceptable for the
grant of an Adoption visa.
As adoptive or prospective adoptive parents, you need to
ensure that any privately arranged adoption is lawful in the
child’s home country.
There is no provision to grant a visa to a child who does
not meet the circumstances for this visa even if an
adoption, that is lawful in the child’s home country, has
occurred.
Important: If you want to proceed with
an adoption from overseas, which has not been arranged by
your Australian State and Territory Adoption Authority, it
is strongly recommended you first seek legal advice both in
Australia and in the country where the child lives.
Sponsorship requirements
The applicant must have been adopted or be in the process
of being adopted by the adoptive or prospective adoptive
parent who must act as sponsor for the child. Sponsors must
be aged 18 years or over, and be one of the following:
- an Australian citizen
- the holder of an Australian permanent visa
- an eligible New Zealand citizen.
Note: A sponsor who is an eligible New
Zealand citizen must also meet health and character
requirements.
Age of child
The applicant must must be under 18 years of age at the
time their application is lodged. If the applicant is under
18 years of age at the time of application but will turn 18
before the application is decided, they will not be eligible
for this visa.
Important: The applicant must be single
and not any of the following:
- married
- in a de-facto relationship
- engaged to be married.
Health
The applicant must meet health requirements.
Character
Applicants who are 16 years of age or over must be of
good character to enter or remain in Australia.
Reliance on social security
If the applicant, or their sponsor, is likely to become a
high user of Australia's social security system, an
Assurance of Support (AoS) from an Australian citizen or
Australian permanent resident, may be required. If required,
the department will advise how an Assurance of Support is
obtained.
The child must have been adopted or be in the process of
being adopted by an adoptive or prospective adoptive parent.
The child must be outside Australia when their visa
application is lodged and when the visa is granted.
Responsibilities
The department will assess and decide applications for
this visa in accordance with Migration Regulations.
